Mobile.Cards Service

Standard Terms & Conditions

  1. In these Terms and Conditions, " Mobile.Cards " refers to Wee Creation Company Limited or its affiliated companies (including the Taiwan branch of the Hong Kong company Mobile Mocha Limited), or the Mobile.Cards entity specified on the service invoice or receipt issued to you by Mobile.Cards (as applicable).
  2. These Terms and Conditions apply to the relationship, rights, obligations, and responsibilities between you and Mobile.Cards regarding your use of the Mobile.Cards membership system services, and also cover the terms and conditions referred to in any contract you enter into with Mobile.Cards . Use of any resource within the Mobile.Cards membership system (including but not limited to the CardsAPP, the Door staff system, the Door Pro staff system, the mBooking service, the mTakeOut service, and the Office backend system — http://office.mobile.cards/ ) constitutes your acknowledgment that you have carefully read and understood these Terms and Conditions and agree to be bound by them. The scope of application of these Terms and Conditions is not limited by the name of the membership system service. These Terms and Conditions constitute a legally binding contractual document between you and Mobile.Cards . If you do not agree to any content of these Terms and Conditions, you should not purchase or use any membership system service offered by Mobile.Cards . If you have any questions about the membership system service or these Terms and Conditions, please email info@mobilecardspro.com and include the name of your membership application or website link.
  3. The scope of Mobile.Cards membership system services covers the presentation and management of the consumer-facing front end within the membership system: the Door staff system, Door Pro staff system, Office backend management, Mobile.Cards Express add-on terminal, and so on. The actual scope of service depends on the plan you ultimately purchase. The membership system service also includes various third-party service providers (hereinafter "Third-Party Service Providers"), including but not limited to the mobile application stores App Store (Apple) and Google Play Store, the login SMS verification service Firebase, Facebook, and Amazon Web Services. Depending on actual operational needs, Mobile.Cards reserves the right to add, remove, or change Third-Party Service Providers at its own discretion.
  4. Through the Mobile.Cards Office backend management platform or other channels provided by Mobile.Cards , you may upload content yourself and have it displayed publicly, including but not limited to on the consumer front end. Mobile.Cards is not responsible for any content you upload; you must ensure the content is appropriate and that you fully own the right to use it and its intellectual property. If content you upload does not belong to you, involves infringement, is unlawful, or violates the terms and conditions of any Third-Party Service Provider, Mobile.Cards has the right to remove such content at its own discretion without notice and to terminate your access rights; if such content causes Mobile.Cards any loss, Mobile.Cards will seek compensation from you accordingly. In addition, some Third-Party Service Providers (including but not limited to App Store (Apple) and Google Play Store) have final decision-making authority over the publication of your content or the listing of your application, and Mobile.Cards cannot and does not guarantee that your content will pass review by Third-Party Service Providers.
  5. Regarding the mobile application for the Mobile.Cards membership system service, Mobile.Cards supports the iOS (iPhone) and Android platforms. The Mobile.Cards system is compatible with the latest version and the previous two versions of the corresponding mobile operating system (for example: if the current latest iOS version is iOS 15, the application will be compatible with iOS 13, iOS 14, and iOS 15; if the current latest Android version is Android 11, the application will be compatible with Android 9, Android 10, and Android 11). Mobile.Cards does not support Huawei phones or their software store. Mobile.Cards does not guarantee that the membership system service's mobile application will be compatible with older OS versions, individual non-native Android brand systems, tablets, laptops, or other software platforms.
  6. You are responsible for ensuring the information security of the software, hardware, and other electronic devices you use in connection with the Mobile.Cards membership system service, including but not limited to setting passwords of adequate strength (recommended: 8+ characters, containing numbers, uppercase letters, lowercase letters, and special symbols), changing passwords regularly, and adjusting or revoking system access permissions when personnel changes occur. Mobile.Cards is not responsible for any loss arising from your negligence regarding information security. You should also regularly back up all relevant data within the system; Mobile.Cards does not guarantee the completeness or accuracy of information within the system.
  7. Records generated within the system when you use the Mobile.Cards membership system service (including but not limited to points, stored value, discounts, credits, etc.) are merely numerical records and carry no actual monetary value. Under no circumstances will Mobile.Cards be responsible for the accuracy or completeness of such numerical records. You are responsible for regularly backing up and checking these records yourself; Mobile.Cards is not responsible for any loss caused by system records.
  8. Regarding member data and related records that you collect through a membership program launched using the Mobile.Cards system, Mobile.Cards will not transfer such data or content to other merchants unless authorized by you.
  9. You understand and acknowledge that the Mobile.Cards membership system service is a modular cloud service. Unless otherwise agreed in writing, the service does not include any customized content; the processes, interfaces, and designated Third-Party Service Providers within the system follow a common, standardized format, and Mobile.Cards does not guarantee that any part of the existing service can be modified. Mobile.Cards will also periodically carry out comprehensive updates to the system, at which time the service's processes and interfaces may change; Mobile.Cards will not provide separate notice of such changes.
  10. You understand and acknowledge that the services provided by Mobile.Cards consist solely of technical support for launching the membership system; you are responsible for resolving and handling all inquiries or complaints from customers who participate in the membership program.
  11. The login SMS verification service provided within the Mobile.Cards membership system service is supplied by a Third-Party Service Provider. Mobile.Cards cannot and does not guarantee that the Third-Party Service Provider's pricing policy will remain unchanged, and Mobile.Cards reserves the right to change the related service fees in response to changes in the Third-Party Service Provider's pricing policy.
  12. Content currently provided within the Mobile.Cards membership system service may be related to the policies of Third-Party Service Providers (including but not limited to push notifications, App Store and Google Play Store publication, login SMS verification, POS providers, etc.). Use of the Mobile.Cards membership system service also constitutes your agreement to the terms and policies of the relevant Third-Party Service Providers. If a Third-Party Service Provider's terms, pricing plan, or service policy changes, Mobile.Cards has the right to add or adjust fees, or to change the relevant service provider, in response. Mobile.Cards will notify you in writing of such changes, and you will need to agree to them in order to continue using the service.
  13. Below are some of the terms or policies of Third-Party Service Providers currently used by Mobile.Cards . This list does not represent all Third-Party Service Providers, and Mobile.Cards also reserves the right to change the system's Third-Party Service Providers at any time. You are responsible for regularly reviewing the relevant terms yourself:
  14. For the terms of any connected POS provider, please inquire directly with that company.
  15. In addition, Mobile.Cards does not guarantee that Third-Party Service Providers are available in all regions or on all phone models. If a Third-Party Service Provider's service is unsupported in a given case, Mobile.Cards will be unable to guarantee, and does not guarantee, the completeness or stability of the membership system service.
  16. You understand and acknowledge that you will share certain cloud servers and database systems with other users. Mobile.Cards operates a fair-use policy; if your usage is significantly higher than that of other users, Mobile.Cards reserves the right to restrict your use of certain system functions in order to protect the rights of other users. If needed, you may discuss with Mobile.Cards the option of an enterprise-level service with a dedicated, independent server.
  17. If, as a result of your violation of these Terms and Conditions or the policies of a Third-Party Service Provider, Mobile.Cards becomes subject to a claim for compensation from any third party (including but not limited to other Mobile.Cards users and Third-Party Service Providers), you shall fully indemnify Mobile.Cards and hold it harmless from any resulting damage or loss. The scope of indemnification includes but is not limited to the amount claimed by the third party, as well as the reasonable expenses Mobile.Cards incurs in handling such claims (including but not limited to attorneys' fees and litigation costs).
  18. Under no circumstances will Mobile.Cards be liable to you or any third party for any loss arising from use of the Mobile.Cards membership system service (including but not limited to loss of revenue, loss of anticipated profits, data loss, system downtime, or direct, indirect, special, incidental, or punitive damages). Mobile.Cards ' cumulative liability to you for damages shall not exceed the total service fees you paid during the period in which such liability arose.
  19. You understand and agree that Mobile.Cards and each Third-Party Service Provider are independent entities, each bearing its own legal responsibility, with no joint venture or partnership relationship between them. Mobile.Cards bears no responsibility for the acts or omissions of any Third-Party Service Provider. If any improper conduct (such as breach of contract or infringement) occurs on the part of a Third-Party Service Provider, you must seek compensation directly from that Third-Party Service Provider, not from Mobile.Cards .
  20. If you wish to terminate the service, you must give Mobile.Cards written notice of termination at least thirty (30) days in advance. If the advance notice period is less than thirty days, you must pay the service fee for the final full month.
  21. If any provision of these Terms and Conditions is held invalid or unenforceable under any applicable law or regulation, that provision will automatically be replaced by a valid, enforceable provision that most closely reflects the original meaning and purpose of the provision to the greatest extent possible, while the remaining provisions of these Terms and Conditions remain unaffected.
  22. Mobile.Cards has the right to modify, add to, or delete the content of these Terms and Conditions from time to time. Updated Terms and Conditions take effect upon publication or upon notice sent to the contact method you have provided (including but not limited to email), and thereupon become a legally binding contractual document between you and Mobile.Cards regarding the Mobile.Cards membership system service. In the event of any discrepancy between the above service content and these Terms and Conditions, the Chinese-language version shall prevail. Please review the Terms and Conditions page on the Mobile.Cards website regularly, and pay attention to notices issued by Mobile.Cards , to ensure you remain aware of and comply with updates to these Terms and Conditions.
